General definitions and interpretation

Access means the level of access to the eRegistration System that is given to each User.

Account means an account maintained with Tailte Éireann by the Account Holder which may be utilised by a User for access to eRegistration Services.

Account Holder has the same meaning as Account Holder in the Land Registration (Fees) Order 2012 (S.I. No. 380/2012).

Act of 2009 means Land and Conveyancing Law Reform Act 2009 (No. 27 of 2009) and words or expressions defined in the Act have the same meaning as in the Act, where the context so admits.

Act of 2006 means Registration of Deeds and Title Act 2006 (No. 12 of 2006) and words or expressions defined in the Act have the same meaning as in the Act, where the context so admits.

Act of 1964 means Registration of Title Act, 1964 (No. 16 of 1964) and words or expressions defined in the Act have the same meaning as in the Act, where the context so admits.

Address for service of notices means the nominated email address of an Account Holder or Tailte Éireann for the service of all notices in relation to the Service.

Contact Details means a person's work address, work number and work email address, to which notices and other communications may be sent under these terms and conditions.

Data means the records and information used in connection with the Service and held as part of the Databases (including Data added to the Databases by using the Service).

Database(s) means Tailte Éireann’s Database(s) on which is stored the Data, together with other Data which the Account Holder may or may not be entitled to retrieve.

Date of Commencement means the date on which the User(s) is granted access to the eRegistration application System or the date on which access to the System is first made available by Tailte Éireann to the Account Holder whichever is later.

ePayment or ePayment service means the system of notification and payment/collection of registration or other fees due to Tailte Éireann by the Account Holder.

Fee(s) means the Land Registration fees payable for registration services as set out in the Land Registration (Fees) Order 2012 (S.I. No. 380/2012) and all intermediate or subsequent fees orders amending or extending the fees order.

Form(s) means the Land Registration prescribed form(s) as set out in the Schedule of Forms in the Land Registration Rules, 2012 (S.I. No. 483 of 2012).

P.A.N. means a Personal Access Number which the User must key in when logging on to use the eRegistration website. A P.A.N. will issue to the User in hard copy by post, DX or other method of delivery to their work address.

I.P. address means Internet Protocol address.

Rules means the Land Registration Rules, 2012 (S.I. No. 483 of 2012) and all subsequent rules amending, repealing, rescinding, re-enacting or replacing those rules. Words or expressions used in this document that are defined in the Rules have the same meaning as in the Rules, where the context so admits.


Security Measures means usernames, passwords, P.A.N.s, or other measures provided by Tailte Éireann to enable Access to and use of the System and Services.

Service and Services means those electronic services provided by Tailte Éireann available through remote terminal(s) from the System.

System means Tailte Éireann’s computer system provided by Tailte Éireann to enable access to www.eRegistration.ie and other Services.

User means a person who has been duly authorised by an Administrator/Super User to access the eRegistration System and to use the Services on behalf of the Account Holder and its Auxiliary, where an Auxiliary exists.

User ID means a User ID, User IDs, usernames, P.A.N.s, passwords or other measures allocated to the Account Holder, the Administrator(s)/Super User(s) or directly to the User(s) by Tailte Éireann to enable Access to and use of the Service.

Web Services means those electronic services made available by Tailte Éireann to an Account Holder from the System which provide an interface allowing direct access to certain Data.

Writing includes information in legible form and other modes representing or reproducing words in visible form and any information kept in a non-legible form, whether stored electronically or otherwise, which is capable by any means of being reproduced in a legible form.

Working Day means a day which is not a Saturday, Sunday or public holiday.

www.eRegistration.ie is the online service delivery channel through which Tailte Éireann delivers its eRegistration Services.

Definitions and interpretation specific to eCharging Orders and edischarges Account Holders

Accounts Management means a User(s) specifically nominated by an Administrator(s) under Form ED3 who can conduct any searches or reports on the work conducted by all User(s).

Administrator(s) means a person(s) appointed by the Account Holder to be a main contact for Tailte Éireann in respect of administrative matters relating to eRegistration Accounts. A total of two people must be appointed by the Account Holder to act as Administrator(s). The Administrator(s) shall notify Tailte Éireann of the appointment or removal of all User(s) or changes to their status/Access levels. Administrator(s) can also act as User(s) however an Administrator cannot nominate him/herself to act as a User. This nomination must be done by their counterpart Administrator if required.

Associated Lender means a lending institution which is no longer in operation but remains shown as the registered owner of a charge and for which the Account Holder is entitled to discharge that charge.

Authoriser(s) means the User(s) authorised by the Administrator(s) to verify information created by anotherUser at Level 1 Access stage and authorise the lodgement of the eRegistration application to Tailte Éireann. An Authoriser may also create applications but they cannot authorise applications for lodgement that they themselves have created.

Auxiliary means a secondary lending institution that is currently in operation and forms part of the same umbrella group as anAccount Holder where that Account Holder is also a lending institution. AllUser(s) are entitled to act on behalf of the Account Holder and its’ Auxiliaries. All Auxiliaries must complete and seal the Account Holder application Form ED1 and where appropriate, the form for changes contained in Form ED2 in order for User(s) to create and lodge applications on www.eRegistration.ie on their behalf.

Creator(s) means the User(s) authorised by the Administrator(s) to input the requiredData at Level 1 Access stage in order to create an application for approval by the Authoriser.

eCharging Order means an application lodged by electronic means to Tailte Éireann by an authorised person in the HSE to register a Charging Order under the Nursing Homes Support Scheme. Form 1 which is prescribed under the Regulations 2009 may be made in electronic form by an authorised person by means of an electronic signature within the meaning of section 2(1) of the Electronic Commerce Act 2000. Use of the eRegistration System is only permitted for the purposes of transactions in all respects lawfully carried out.

eDischarge means an application for the cancellation of the entry of a charge made to Tailte Éireann by electronic means where Tailte Éireann is satisfied that appropriate arrangements are in place for effecting such application. The application shall be in the form set out in Form 58 of the Rules. The discharge of Charging Orders registered in favour of the HSE is prescribed under Schedule 1 or Schedule 2 of the Regulations 2009. Use of the eRegistration System is only permitted for the purposes of transactions in all respects lawfully carried out.

eRegistration means electronic registration. This is where the lodgement of documents or instructions occurs in electronic format only and all registrations are made on an electronic register. Use of the eRegistration System is only permitted for the purposes of transactions in all respects lawfully carried out. eRegistration Services include edischarges and eCharging Orders.

Regulations 2009 means the Nursing Homes Support Scheme (Making and Discharge of Orders) Regulations 2009 (S.I. 437 of 2009) and all intermediate or subsequent rules amending or extending those rules and words or expressions defined in the Regulations have the same meaning as in the Regulations, where the context so admits.

Definitions and interpretation specific to eRegistration Account Holders other than eCharging Orders and edischarges Account Holders

Authoriser(s) means the User(s) authorised by the Super User to finalise eRegistration applications created by another User at Level 1 Access stage and authorise eRegistration applications for submission to the Fee Approver.

Creator(s) means the User(s) authorised by the Super User to input the required Data at Level 1 Access stage in order to create an application for authorisation/finalisation by the Authoriser .

eRegistration Services include the preparation of Tailte Éireann prescribed Forms in an electronic environment for subsequent lodgement in hard copy, the ePayment of Fee(s) and the pre-lodgement of applications. Use of the eRegistration System is only permitted for the purposes of transactions in all respects lawfully carried out.

Fee Approver means the User with authorisation to approve payment of fees due to Tailte Éireann by means of ePayment or the ePayment Service.

Reviewer means the level of Access to the eRegistration System allocated to a User that will allow the User to view application details only.

Super User(s) means a person(s) appointed by the Account Holder to be the main contact for Tailte Éireann in respect of administrative matters relating to eRegistration Accounts. A least one Super User must be nominated by the Account Holder. The Super User(s) shall administer theeRegistration Account on behalf of the Account Holder and shall nominate allUser(s) and allocate their User ID and appropriate level of Access to the eRegistration System on behalf of the Account Holder. The Super User(s) shall notify Tailte Éireann of the appointment or removal of all User(s) in the appropriate manner. Super User(s) may also nominate themselves as User(s).

Note: When words appear with a capital letter, in bold and italicised lettering then their specific definitions as set out in the above pages apply. If a word appears in normal plain text then its usual and general meaning will apply.

1 Introduction

1.1 The right to use to Tailte Éireann website, Services and eRegistration.ie and use of the information contained therein is governed by the terms, conditions and notices set out below. Persons using eRegistration.ie and other Services are deemed to have read and accepted all the relevant terms, conditions and notices.

2 eRegistration

2.1 Tailte Éireann will provide a facility enabling the authorised User on behalf of the Account Holder to prepare various electronic applications (known as eRegistration applications, specified from time to time by Tailte Éireann) to enter or cancel entries on the register, to electronically prepare selected applications for registration using the appropriate Forms prescribed by the Rules for subsequent lodgement in hard copy, to facilitate the ePayment of Fee(s) and to pre-lodge selected applications. Application forms will be published on the website which potential Account Holders can download, complete and send to Tailte Éireann in order to avail of the eRegistration service.

2.2 Once Tailte Éireann has received and accepted an application for electronic Services from the Account Holder under Form ED1 or Form ER1 it will be responsible for providing the eRegistration facility to that Account Holder. If electronic access ends for any reason, the eRegistration Service will automatically cease.

3 Right to change the terms

3.1 Tailte Éireann reserves the right to alter these terms and conditions and will publish the current version on its website. Tailte Éireann will notify Administrators and/or Super Users by email of any proposed alterations at least 10 Working Days in advance by publication of a notice on www.eRegistration.ie and by email to Administrators and/or Super Users. Excepting any urgent alteration necessary to protect the security, integrity or stability of the eRegistration System, Tailte Éireann will give theUser(s) 10 Working Days notice of any proposed alterations. Use of the eRegistration System constitutes an acceptance of the terms and conditions then subsisting.

3.2 Tailte Éireann reserves the right (except to the extent that they may be prescribed by the Acts or Rules) to change all or any of the terms and conditions contained in this document.

3.3 All parties agree to submit to the exclusive jurisdiction of the courts of Ireland. If any provision of these terms and conditions is unlawful, void or unenforceable then it is deemed severable and shall not affect the validity or enforceability of the remaining provisions.

4 The System

4.1 Grant of right to use of the System for eRegistration purposes

4.1.1 Tailte Éireann grants to the Account Holder and its Users the right of access and use of the System within their respective Access levels from and including the Date of Commencement.

4.2 Availability of the System

4.2.1 Tailte Éireann may determine the hours of availability of the System and will publish these by notice.

4.2.2 Tailte Éireann will use all reasonable endeavours to maintain the System with the intention of making it available during those published hours and will use best endeavours to restore availability of the System as soon as possible in the event of an interruption or suspension in the availability of the System. Access to theSystem may be denied, prevented or interrupted through circumstances beyond the control of Tailte Éireann .

4.2.3 Tailte Éireann may suspend the System or any part of the System without liability to any Account Holder, where it is satisfied that this may be necessary to protect the System , other Users of the System or Tailte Éireann.

4.2.4 Where all or part of the System has been suspended Tailte Éireann will send a notice of suspension ofServices by email or any other available means to all Administrators and/or Super Users as soon as reasonably possible.

5 Tailte Éireann’s rights and obligations

5.1 Tailte Éireann will provide the Account Holder with technical information and instructions to enable theAccount Holder to access and to use the System, eRegistration, Services and Web Services provided through the System, by means of User Guides.

5.2 Tailte Éireann may stipulate that adequate arrangements are in place for sending and receiving electronic messages and documents to ensure efficient processing of transactions using the System.

5.3 Tailte Éireann may require that arrangements should be in place for ensuring that messages and documents sent through the System can be attributed to the sender.

5.4 Tailte Éireann has the right to maintain an audit log of all use of the eRegistration System.

5.5 Tailte Éireann has the right to ownership and use of its own I.P. address.

5.6 Tailte Éireann reserves the right to extend and enhance the System as is necessary to support the registration process.

5.7 Tailte Éireann has the right to protect its copyright in relation to all data and or computer code that exists in favour of Tailte Éireann.

5.8Tailte Éireann will:

§ keep all User Guides up to date and notify Account Holders via the website of changes to any of these documents

§ provide a help desk to assist the Account Holder and Users to understand the operational requirements adopted from time to time for the use of the System, Services and Web Services provided through the System.

§ publish a list of the edischarges Account Holders and where appropriate their Auxiliaries availing of Services on eRegistration.ie on its website and will endeavour to maintain and update this list at all times.

6 The Account Holder

6.1.1 The Account Holder will:

§ monitor compliance by each Administrator, Super User and User with the terms and conditions and immediately on becoming aware of any unauthorised use of or Access to the System or other breach of these terms and conditions take all reasonable steps both to ensure that such person ceases such activity and to prevent any recurrence of it

§ where necessary terminate User(s) Access to the System and notify Tailte Éireann, as soon as practical, of any suspected infringement, breach or misuse of the Security Measures or any fault or defect in the System,or its Services and Web Services and take such reasonable action as Tailte Éireann directs in relation to such infringement, breach, misuse, fault or defect

§ co-operate fully with Tailte Éireann in the diagnosis and rectification of any such infringement, breach, misuse, fault or defect, and notify Tailte Éireann of any information concerning a User that the Account Holder considers might cause Tailte Éireann to vary Security Measures in relation to that person or to revoke their Access to the System

§ provide to Tailte Éireann up-to date details showing additions, deletions or other alterations of User Access, Administrator and Super User records in the format reasonably required by Tailte Éireann when so requested and where appropriate complete the requisite forms for providing this information

§ ensure that its User ID security arrangements giving Access to theSystem are secure at all times and comply with the System andSecurity Measures and all other terms and conditions as well as the requirements contained in the User Guide when using the System to conduct a transaction

§ ensure that the duties of the Administrator(s)/ Super User(s) contained in the Terms and Conditions and the User Guide(s) are properly performed

§ accept that Tailte Éireann has the right to monitor its use of the System, Services and Web Services

§ ensure that Web Services allowing direct access to certain Data are not misused

§ use all endeavours to prevent any unauthorised person gaining access to the System or to use the Services and Web Services from the Account Holder’s equipment and or software.

6.1.2 The eCharging Orders and edischarges Account Holder will:

§ ensure that only a channel authorised by Tailte Éireann such as a pre-determined I.P. address will be used to access the System. When the Account Holder visits Tailte Éireann web site, Tailte Éireann may routinely log its I.P. address (the unique address which identifies the Account Holder’s computer(s) on the internet). Tailte Éireann will be using I.P. addresses to help them administer their website and to verify the Account Holder’s details

§ nominate two individuals as Administrators to act on its behalf in relation to these terms and conditions

§ notify Tailte Éireann of the nomination of both Administrators by way of the forms provided by Tailte Éireann which will be published on the website

§ nominate a new Administrator as soon as is practical on the cessation of any person as Administrator in relation to the Account Holder, and notify Tailte Éireann of the appointment within two Working Days by completing and returning a new nomination Form ED2.

6.1.3 The Account Holder other than the eCharging Orders and edischarges Account Holder will:

§ nominate a Super User(s) to act on its behalf in relation to these terms and conditions

§ notify Tailte Éireann of the nomination of a Super User(s) by way of the form provided by Tailte Éireann which will be published on the website.

6.2 The Account Holder will not:

§ misuse the System in any way, or cause the System or Access to it to be interrupted, damaged or impaired in any way.

§ attempt to alter or tamper with the Data, System or Databases or otherwise tamper with the Data or System.

§ disclose any Security Measures.

§ infringe the State’s copyright, Tailte Éireann’s copyright or other intellectual property rights or those of any other person in the Data, System or Databases.

6.3 Change in status of Account Holder

6.3.1 The Account Holder will supply information to Tailte Éireann about any change to their name and where any exists the Auxiliary name(s) required to update the System to enable Tailte Éireann to provide the Service at least 10 Working Days before the change takes effect.

6.3.2 The Account Holder and where appropriate their Auxiliary(ies) will supply information to Tailte Éireann if they take ownership over any charge or pending application affecting a Folio.

6.3.3 The Account Holder will notify Tailte Éireann in Writing as soon as practical if it or any of its Auxiliaries ceases to meet any of the criteria required in order to access the eRegistration System and of any fundamental changes in the information supplied to Tailte Éireann as part of its application for right of use.

6.3.4 A “Fundamental Changes” Form ED2/Form ER2 for such notification purposes will be contained in the User Guides supplied by Tailte Éireann to each Account Holder and where appropriate their Auxiliary.

7 Administrator/Super User

7.1 The Administrator(s)/Super User(s) will in the main be the first point of contact for Tailte Éireann in relation to the obligations of the Account Holder under these terms and conditions. However, Tailte Éireann may also contact those members, officers or employees of the Account Holder who have been nominated for such purposes in Form ED1/Form ER1 in addition to or instead of the Administrator(s)/Super User(s) when it is necessary to do so.

7.2.1 The Administrator/Super User will:

  • allocate the appropriate Security Measures to each User (except where such measures are allocated by Tailte Éireann)
  • ensure that each authorised User has and uses their individual User ID, and has been properly trained to use the equipment and/or software to obtain the Services and Web Services
  • notify Tailte Éireann immediately: if a User ID, and/or password becomes known to an unauthorised person, or is no longer to be used by the person to whom it was allocated
  • monitor compliance with these terms and conditions by each authorised User(s) and on becoming aware of any unauthorised use of or access to the System or use of the Services and Web Services or other breaches take reasonable steps to ensure that such person ceases such activity and prevent a recurrence of it
  • perform the other duties of the Administrator/Super User as referred to in the terms and conditions.

7.2.2 The Administrator on eCharging Orders and edischarges Accounts will:

  • nominate a User(s) who will be responsible for Accounts Management by completing Form ED3 and returning said form to Tailte Éireann
  • complete Form ED3 (which will be supplied with the User Guide) to notify Tailte Éireann of the name and Contact Details and allocated Access level of each User(s) as and when they are appointed
  • complete Form ED4 (which will be supplied with the User Guide) to notify Tailte Éireann of any changes to status/Access level of any User or if any person ceases to be a User.

7.3 The Administrator/Super User will not:

permit anyone to use the System on the Account Holder or theAuxiliary’s behalf until he/she has notified Tailte Éireann that such person is a User and has supplied the details of such person as required in the format specified by Tailte Éireann.

8 Accounts Management on eCharging Orders and edischarges Accounts only

8.1 The User(s) with Accounts Management rights has been specifically nominated by an Administrator(s) and can conduct any searches or reports on the work conducted by all User(s) under the search applications facility.

Note: All User(s) will as standard have access to the transactions that they have been a party to themselves.

9 User(s)

9.1 User(s) on eCharging Orders and edischarges Accounts only

9.1.1 The role of the User(s) is to create and/or authorise eRegistration applications for lodgement on behalf of the Account Holder (and where an Auxiliary exists the User(s) will be entitled to act on behalf of the Auxiliary also).

9.1.2 All forms for nomination of User(s) and completion by the Administrator andUser(s) are contained in the User Guide which is published on the website and should be completed and returned to Tailte Éireann after the Account Holder has made its application to avail of theeRegistration System and been approved by Tailte Éireann to use the eRegistration System.

9.1.3 There is no limit on the number of User(s) that may be nominated by an Administrator(s) for Access the eRegistration System. However, at least one Authoriser must be nominated by an Administrator(s).

9.2 Users on other eRegistration Accounts

9.2.1 The role of the User(s) is to create and/or authorise eRegistration applications for pre-lodgement and/or authorise ePayments for applications and/or review applications on behalf of the Account Holder.

9.1.2 All User(s) should be nominated by the Super User(s) after the Account Holder has been approved by Tailte Éireann to use the eRegistration System.

9.2.3 There is no limit on the number of User(s) that may be nominated by a Super User(s) for Access the eRegistration System. However, at least one Creator, Authoriser and Fee Approver must be nominated by the Super User(s). A User can be nominated to one User role or to any combination of User roles.

10 User ID

10.1 User ID on eCharging Orders and edischarges Accounts only

10.1.1 Confirmation of the username and password for each User will issue to the User by email and the username details will issue to both Administrators by email.

10.1.2 The P.A.N. is automatically generated by the system and is encrypted. Tailte Éireann staff would not at any time have right of access to this code. The P.A.N. will only issue to the User(s) in hard copy by recorded delivery to their work address.

10.1.3 Issued passwords can be changed by the User(s) under the Manage Account option in the main menu.P.A.N.s cannot be changed. Any requests to re-set a P.A.N. or password (e.g. whenP.A.N. or password has been mislaid or forgotten) must be submitted by email to eRegistration@prai.ie by an Administrator.

10.1.4 The new P.A.N. will issue in hard copy to the User’s work address by recorded delivery and the new password will issue to the User by email. Confirmation that this action has been performed by Tailte Éireann will issue to both Administrators.

10.1.3 User ID on other eRegistration Accounts

10.2.1 The username for each User will be their email address, a password for each User will issue to the User by email.

10.2.2 The P.A.N. is automatically generated by the system and is encrypted. Tailte Éireann staff would not at any time have right of access to this code. The P.A.N. will only issue to the User(s) in hard copy by post, DX or other method of delivery to their work address.

10.1.4 Issued passwords can be changed by the User(s) under the Manage Account option in the main menu. Passwords can be re-set by the Super User(s).

10.1.5 P.A.N.s cannot be changed. Any requests to re-issue a P.A.N. (e.g. whenP.A.N. has been mislaid or forgotten) must be submitted by the Super User. The new P.A.N. will issue in hard copy to the User’s work address by post, DX or other method of delivery.

11 User Access

11.1 User Access on eCharging Orders and edischarges Accounts only

11.1.2 There are two separate Access levels to eRegistration. Level 1 Access will be allocated to a User called a Creator. The Creator inputs the required information in order to create one of the eRegistration application types for approval by an Authoriser.

11.1.2 The Authoriser is the User that has Level 2 Access and verifies the information inputted by a Creator. The Authoriser authorises the lodgement of each eRegistration application type to Tailte Éireann.

11.1.3 Authorisers may also log on as Creators at Level 1 Access stage. However, Authorisers cannot authorise applications for lodgement that they themselves have created.

11.1.4 User(s) may not assign, transfer or otherwise deal with their authorisation to use the eRegistration System.

11.2 User Access on other eRegistration Accounts

11.2.1 There are four separate Access levels to eRegistration. Level 0 Access will be granted to a User with Reviewer Access; this allows the User to view all of the eRegistration applications on the Account. Reviewer Access does not allow a User to access other eRegistration Services.

11.2.2 Level 1 Access will be granted to a User called a Creator. TheCreator inputs the required information in order to create one or more of the eRegistration application documents for authorisation/finalisation by an Authoriser.

11.2.3 The Authoriser is the User that has Level 2 Access and authorises/finalises the documents created by a Creator. The Authoriser submits the eRegistration application to the Fee Approver for approval of the ePayment of the fee to Tailte Éireann. The Authoriser can authorise/finalise applications that he/she has created.

11.2.4 The Fee Approver is the User with Level 3 Access. The Fee Approver approves the ePayment of the fee to Tailte Éireann and pre-lodges the application for registration. The Fee Approver can approve fees for applications that he/she has created and/or authorised/finalised.

11.2.5 User(s) may not assign, transfer or otherwise deal with their authorisation to use the eRegistration System.

12 User ID and Access to the System

12.1 If a User ID has not been used to gain Access to theSystem for a period of 50 Working Days, Tailte Éireann may cancel that User ID without giving prior notice to the Administrator/Super User.

13 Security

13.1 In the event that Tailte Éireann or the Account Holder discovers, is made aware of or suspects any breach of security, they will immediately notify the other party.

13.2 Tailte Éireann reserves the right at any time to revoke the Security Measures being used by any particular User(s) in order to protect the System, other Users of the System, or Tailte Éireann.

14 Suspension of Access

14.1 Tailte Éireann may suspend Access to the System by any User(s) where it is satisfied that this may be necessary to protect the System, other Users of the System, and Tailte Éireann, or theUser(s) has not used the System at any time within any continuous period of at least 50 Working Days beginning not earlier than the Date of Commencement.

15 Exclusion and limitation of liability

15.1 Neither Tailte Éireann nor any third party shall be liable for any loss or damage, direct, indirect or consequential, arising from any interruption temporary or otherwise in the availability of the System or Access to the Services, Web Services or Data.

16 Force Majeure

16.1 Neither party will be liable for any delay in performing or failure to perform any of its obligations under these terms and conditions caused by events beyond its reasonable control.

17 Serious breach

17.1 A serious breach of the terms and conditions will allow Tailte Éireann to terminate entry to the System and the eRegistration System. A serious breach includes but is not limited to:

an act or failure to act which, in the opinion of Tailte Éireann, damages or threatens the security or integrity of the System, information on the System, the register, or other information kept by Tailte Éireann in electronic form.

18 Privacy Statement

18.1 General

18.1.1 This statement relates to the privacy policy of the Tailte Éireann specifically in relation to the eRegistration.ie website and incorporates the terms of the privacy statement(s) within other websites operated by Tailte Éireann, such as www.landdirect.ie and www.tailte.ie.

18.2 Use and Disclosure of Information

18.2.1 Tailte Éireann may collect information about the Account Holder for the following purposes:

§ to facilitate Access to and use of the System

§ to assist the Account Holder in the administration of the Account

§ to enable Tailte Éireann to ensure that all User(s) are granted the appropriate Access level

§ to enable Tailte Éireann to ensure that the Account Holder is using the System in an appropriate manner

§ for reporting and statistical purposes, and for any other lawful purpose including fulfilment of Tailte Éireann’s legal obligations.

18.2.2 The Account Holder acknowledges and agrees that Tailte Éireann may be obliged to disclose details relating to it to third parties, in order to conform to any requirements of law or to comply with any legal process.

18.3 Security of Information

18.3.1 Any information provided by the Account Holder or collected about the Account Holder will be treated with the highest standards of security and confidentiality. Our security policies are periodically reviewed and enhanced as necessary.

18.4 Links to Third Party Websites

18.4.1 This site may contain links to the websites of third parties. Tailte Éireann is not responsible for the privacy policies or the content of third party sites and we recommend that you read their privacy policies when you wish to visit such sites.

18.5 Updates and Amendments to Privacy Statement

18.5.1 Tailte Éireann reserves the right at its sole discretion to amend this privacy statement at any time, and the Account Holder should check this privacy statement regularly for any amendments.

19 Waiver

19.1 Failure on the part of either party to enforce any of these terms and conditions will not be construed as a waiver of such terms or a waiver of the right to enforce any of the terms and conditions at a later time.

19.2 The termination of these terms and conditions does not relieve either of the parties of their prior respective obligations or impair or prejudice their respective rights against the other if such obligations or rights arose prior to termination.

20 Termination of Access

20.1 Access to the System will automatically terminate:

  1. when there has been no use of the System pursuant to the terms and conditions for a continuous period of one year at any time after the Date of Commencement
  1. and can be terminated by Tailte Éireann or Account Holder at any time by notice to/from Tailte Éireann in Writing.

20.2 On termination of these terms and conditions, the Account Holder must return all articles constituting or containing Security Measures supplied by Tailte Éireann, if required to do so.
